Express Interview Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Instage Inc. ("Instage," "we," "our," or "us") for your use of the Express Interview consumer service, the website at `expressinterview.ai`, and related features (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Scope and Related Policies

These Terms incorporate the following documents:

  • Subscription Terms (`docs/legal/subscription-terms.md`)
  • SMS Terms (`docs/legal/sms-terms.md`)
  • Privacy Policy (`docs/legal/privacy-policy.md`)

If there is a conflict between these Terms and the Subscription Terms regarding billing or plan rules, the Subscription Terms control.

For clarity, these Terms apply to Express Interview at `expressinterview.ai` and related Express Interview services, and do not govern other Instage websites or products.

2. Eligibility and Availability

You may use the Service only if:

  • You are at least the age of majority where you live.
  • You have authority to use the phone number you provide.
  • You are located in the United States or Canada.
  • You are not prohibited by applicable law from using the Service.

The Service is currently intended only for users in the United States and Canada. We may block or limit access outside those countries.

3. Service Description

Express Interview is a phone-based AI interview practice product. You provide your name, phone number, and role details. We may call your phone, process call audio and transcripts, and send transactional SMS messages (for example: OTP verification, READY/status updates, and report links).

The Service is provided for interview practice and informational purposes only. We do not guarantee employment outcomes, interview outcomes, or accuracy of AI output.

4. Account and Phone Number Identity

Your verified phone number is your account identifier.

  • You are responsible for all activity on your account/phone number.
  • You must keep your phone number and device access secure.
  • Entitlements are non-transferable except as expressly allowed in the Subscription Terms.
  • Paid access is bound to the verified phone number used at purchase.

5. Purchases, Plans, and Refund Policy

Paid offerings, auto-renewal rules, usage thresholds, cancellation, and transfer rules are described in the Subscription Terms.

Satisfaction Guarantee

If you are not satisfied with the Service, you may request a refund within 7 days of your original purchase date by contacting us through the support chatbot on `expressinterview.ai`. Refunds under this guarantee are issued at Instage's discretion to the original payment method. This guarantee applies once per customer.

General No-Refund Policy

Except for the satisfaction guarantee above and where required by applicable law:

  • All purchases are final.
  • No refunds or credits are provided for used or unused interviews, partial billing periods, latency, call quality issues, or account inactivity.
  • Credits and subscriptions are non-transferable and non-refundable.

6. Fair Use and Prohibited Conduct

You agree not to:

  • Share, resell, lease, sublicense, or commercially exploit the Service.
  • Use bots, scripts, automation, or call-forwarding setups to generate artificial volume.
  • Circumvent rate limits, usage limits, account controls, or phone-number binding.
  • Create multiple accounts to evade restrictions or enforcement.
  • Use abusive, threatening, harassing, discriminatory, or unlawful language/content.
  • Reverse engineer, probe, or interfere with the Service, telephony systems, or AI systems.

For unlimited plans, usage above normal individual interview practice may be treated as abuse. As stated in the Subscription Terms, usage above 100 interviews in any rolling 30-day period is considered abusive unless we expressly approve otherwise in writing.

We may queue, throttle, restrict, suspend, or terminate accounts for abusive or prohibited use.

7. Telecom and Latency Disclaimer

The Service depends on third-party telecom and network infrastructure outside Instage's control, including carriers, device manufacturers, cloud providers, and internet/phone networks.

We do not guarantee:

  • Call completion, quality, clarity, or latency.
  • Uninterrupted or error-free operation.
  • Delivery timing of SMS or phone calls.

If calls are delayed, degraded, dropped, or otherwise affected by latency/network conditions, you accept that risk. Except where required by law, these issues do not create a right to refund, credit, or damages.

8. Consent to Calls, SMS, and AI Processing

By using the Service, you consent to:

  • Receiving transactional calls and SMS messages related to your account and interviews.
  • Processing of your call audio, transcripts, role inputs, and related content by our service providers and AI systems to provide and improve the Service.

You can opt out of SMS with STOP as described in the SMS Terms, but some core functionality may not work without SMS.

9. Report Links and Security

Report links may include access tokens. Anyone with the link/token may be able to access the report. You are responsible for safeguarding links sent to your phone and device.

10. Your Content and Permissions

You represent that you have rights to provide the content you submit (for example: job descriptions, role details, and spoken responses).

You grant Instage a worldwide, non-exclusive, royalty-free license to host, process, reproduce, analyze, and display your submitted content as needed to provide, secure, and improve the Service.

11. Third-Party Services

The Service uses third-party providers, including telephony, payment, hosting, and AI providers. Their outages, API changes, or failures may affect the Service.

Your payment transactions are processed by Stripe under Stripe's terms and policies.

12. Intellectual Property

The Service, including software, interfaces, branding, and content (excluding your content), is owned by Instage or its licensors and is protected by law.

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, lawful interview practice in accordance with these Terms.

13. Suspension and Termination

We may suspend, limit, or terminate access immediately if we determine that you violated these Terms, created risk, abused usage, or engaged in fraud/unlawful activity.

You may stop using the Service at any time. Subscription cancellation does not automatically delete your account data; data handling is governed by the Privacy Policy.

14. Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • INSTAGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, AND SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.
  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) USD $100 OR (B) THE AMOUNT YOU PAID TO INSTAGE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain liability limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Instage and its affiliates, officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of law or third-party rights.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Except where prohibited by applicable consumer law, you and Instage agree that any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there.

Nothing in this section limits non-waivable consumer rights under applicable law.

18. Changes to Terms

We may update these Terms from time to time. We will post the updated version with a new "Last Updated" date. Your continued use after changes become effective means you accept the updated Terms.
